In a boon for North Carolina restaurants, on July 8 North Carolina Governor Roy Cooper signed the ABC Omnibus Bill relaxing several regulations for alcohol sales. Senate Bill 527 authorizes cocktails to-go and delivery by mixed beverage permittees or delivery service permittees, and also exempts pre-mixed cocktails up to 13% ABV from the state’s mixed beverage tax. Cocktails to-go orders must be made with a food purchase and placed in tamper-evident containers.
The bill, passed by the North Carolina Senate on June 27, reinstates the temporary measure allowing cocktails-to-go that was adopted during the COVID pandemic and sunset in June 2021.
“North Carolina spirits consumers are one step closer to enjoying increased convenience with the passage of SB 527,” said Andy Deloney, Distilled Spirits Council of the United States senior vice president and head of state public policy, in a statement after the bill’s passage. “Lowering the tax rate for spirits ready-to-drink cocktails, allowing cocktails to-go and permitting holiday sales are all measures that will benefit local hospitality businesses and the consumers they serve…”
